Florida landlord-tenant law
Security deposits, late fees and notice periods for Florida landlords, in plain English, with a link to the statute for each rule.
Security deposit limit
No statutory limit.
Deposit return deadline
15 days if nothing is deducted. To keep any of it, the landlord must send written notice of the claim by certified mail within 30 days.
Late fees
No statutory cap or grace period. The fee must be in the lease and reasonable.
Notice for unpaid rent
3-day notice to pay or vacate (excluding weekends and legal holidays).
Ending a month-to-month lease
30 days' written notice before the end of a monthly period (changed from 15 days in 2023).
Rent increases
No state rent control; Florida preempts local rent control. Follow the lease; month-to-month requires a full period's notice.
Local rules: Some counties and cities require extra notice for rent increases over 5%; check local ordinances.
